As long as he leaves the buffer tube naked with no stock it is a pistol and does not have to have a 16 inch barrel. Must be registered as a pistol too, can't just take off the stock on a regular AR and throw on a short upper. I believe that is how it goes.

correct, lower must be built as a pistol and registered as a pistol, putting a stock on it turnes it into an AOW, and putting a 16" upper on it is also not advisable, i had to buy a complete pistol with single shot sled, and then wait the 10 days, then selling back the upper to have a registered pistol AR lower

Yes. Word of law is on how the gun comes from factory. A more easier to understand example is pistol grip shotguns.
