Ok. . .well. . .thats pretty frigin messed up. Buerocratic red tape exists so that people will not be able to abuse the system, however, it seams the extenuating circumstances of this instance are so obvious its almost criminal that the officers in control of his discharge didn't make an exeption.

it was a paper work error and he didnt want to stay in long enough for the nonsense appeal to go through. sounds like the system was just slow.

You've had so many cases of soldiers smuggling their gear back to the states in the past when they get discharged that now they are having to crack down on it. A lot of people in the past have gotten their load bearing gear and even their rifles back with them some how and the military just wrote it off as a loss. But when you are head of supplies for the army and seeing a HUGE deficit with politicians breathing down your neck every day, you'll change to a more stricter policy quickly. This case as mentioned, was because he was too impatient and wanted to get discharged before they could review the situation out. To them, it seemed as though he had a friend take it for him to send it back home to him so they wanted to make sure he wasn't going to be smuggling gear from them. My uncle got his 1911a1 out without almost no problems at all. I have heard many easilly getting their m16s and now eve their m4s back. A few bad apples spoil the barrel.
