I must be fuggin retarded, im gettin stomped on left and right these days, so me and my lady are going to reno on tuesday, we get rearended by a fool going about 50,

yo juanito, dude thats nothing, go back to your insurance comp and tell them, dont mess with those checks. tell them that your neck injury is more worse then before, goto a chiro. get an estimate of what the damages are and tell them whats up. the other insurance should cover it, if not and the dude that hit you wants to fight it, take it to court (small claims) youll get reward'd a good settlement as long as the judge isnt a dick.

If your insurance company has issued you two $250 checks that quick it sounds like bullshit to me. It sounds like they are wanting to settle before you've had a chance to really get into the depth of your injuries. In most circumstances whiplash and back injuries do not present themselves until a few days afterward. I would do one thing above all else, HIRE A LAWYER!! Protect your rights as a consumer and as a citizen. You do have rights even though you signed some type of statement. You were not in the full aquaintance of the law so thus whatever paperwork you signed should be considered to be null and void since you were under duress.

Juan, I've has some small dealings with situations like yours (workers comp for my employees). I'm not sure about the paper work you signed, but don't cash the checks. By cashing the checks you accept their offer. By not cashing them it is almost as if you have not made a settlement. My sister is a lawyer (but she handles mainly immigration), I will call her tomorrow and see if she has any suggestions.

yeah i know that now, their INS gave me the check.

Actually, you might not be screwed at all. One lawyer will tell you something completely different than another, just if u do retain an attorney, get it on a Contingency Fee basis so that u don't have to fork out $6000 right off the bat. If your feeling numbness in your extremeties that means u have a spinal injury, thats quite a substantial settlement, i've seen them upwards to $100k settlements.

Hey Poison sounds like you defianetly have a case.Most attorney works on a percentage I think its about 33% of your settlement.The way they work your settlement is by adding up all your Doctor bills and then times that by 3.There are alot of attorneys that will take your case without any money upfront.As for the check then gave you as soon as you cash it the case is closed,so I would say send it back and let them know that your getting a lawyer.By doing that they might counter offer with alot money.When I was rearended I did everything without a lawyer and I got close to 12,000 plus an additional 1700.00 to have my car fix.Thats all the stuff they look at damage to your car etc make sure that you ask them for car rental fees also they have to pay you for that.If possible get quotes on your car having it repaired they will then cut you a check for that make sure you get high quotes.If you need a great bodyshop let me know.I can help u save a ton of money.Any other help let me know.Hope things good well.
