Close Call with Sac Sheriff's Dept.
Well, last night around 11:15pm, myself and a friend were leaving the golf course on Fulton Ave. in separate cars. As we passed Marconi, a Sac Sheriff passed us on the other side of the street, then made a quick 180 turn to get behind my friend. He shined his lights and pulled my friend over. But, as for me I kept driving, heading home. Well, he had his airsoft gun bag in the back seat of the car. There was no visible sign of the gun. As the officer was walking up to the car....he saw the bag. From what was told to me by my friend, the officer got spooked. The officer asked him what was in the bag. My friend replied, "It's an airsoft gun." The officer wasn't convinced yet. Then my friend was told to get out of the car. Asked if he had any other items in the car, which he told the officer that his 2 gas bback pistols were in the bag. So, my friend sat in the back of a Sheriff's car for about 1 hour....watching 10 officers go through his car. The 10 officers were so surprised that the guns looked so real that they looked at their sig226 and looked at the TM p226. They also took pictures for record to show other officers what the Airsoft guns looked like.

Well the reason why they pulled him over was because he had a light broken above his license plate. So that was the reason, and when he shined the light in the back seat and saw the rifle case...well....you know how it is.

that sucks pretty bad, there was this one time when my stupid ass friends were playing with GBB in public, it was a private little place but public none the less and someone saw them and they sent one cop... the cop went through everyone's guns and had to run a serial check on each one, turns out that some idiot reported a chrome 9mm being stolen and my friend happened to have that airsoft gun. funny thing is the seriel # on the GBB matched which probably means some idiot reported a GBB stolen to the cops... anyhow i had to run down there with the reciept to show them it was legal and purchased at an airsoft store. morale of the story is dont be stupid with airsoft guns

So then if an officer sees as he posted, "a bag" that (according to your definition) is, "...evidence of criminal activity or the product of a crime can be seen without entry or search."
Its a GUN BAG..Not a plastic bag, paper sack, potato bag, sandwich bag...a GUN BAG. So with that said it would not take much to discern that a GUN might be in it...Guess what there was one. That it was an airsoft gun is besides the fact...

I mean, you say you have a black duffel bag where you place your guns at. If it was in your back seat, and the officer asks you around 11:15 at night and sees it.....you don't think the officer was right to do that?

Gun control is not Crime control.
But if you get out of the car and shut the door behind you, don't they need a warrant to enter and search the vehicle unless you grant them permission?
Here's the thing, if the police asks you a question about looking in your car, and you're cool with them doing it, and if you have nothing to hide, let them do it, and they'll send you on your way. But, if you show any kind of hesitation, that will not make the situation any easier. I mean, in the officer's mind set, he might be thinking you have something to hide. So, for my friend to let the Sheriff's Dept do what they needed to do, I think he made the right call, not to mention he was honest and up front with the officer anyways.
As far as the stop that the officer made. The reason does not matter. With all that is going on out of country and IN country, any weapon (real or not) being in your vehicle that you tell an officer about, should and will be investigated. Ultimately, he was let go with his gear still his. As far as the time frame that the officer took to call all of his buddies to come and look at it.... that is just officer stuff (meaning that they do it all the time on stops). Not that there is anything wrong with that (unless it is you sitting in the back of a cruiser). Again, I am not passing judgement on the stop, or the time that it took to get it over with. Just be happy that you still have your gear and you are not in jail. But (up on the soap box), it may be safer to keep your gear in the trunk during transport.

A vehicle does not necessarily need a warrant as it is a mobile conveyance. Under the law a vehicle in this category does not need a warrant under certain circumstances. The officer made a legitimate stop and had reasonable suspicion of a potential crime. Under the Carroll Doctrine the officer may conduct a warrant less search. If I'm conducting a search warrant at residence and the subject drives up in a car and the car isn't listed on the warrant, under the Carroll DoctrineI can still search the car as it can drive away with fruits of a crime.

Every stop is going be unique but given those circumstances and you said no to a search, I can't see where the officer would have enough reasonable suspicion to search your vehicle or even have any reasonable suspicion that there's something beyond a broken tail light.
